Terms of use

The short version: read, share and quote freely with credit; check important figures against the official source we link; and nothing here is advice. Paid newsletter subscriptions are billed and managed through Substack.

Who we are

The Open Count (“we”) publishes this website, theopencount.com, and The Open Count newsletter. By using the site or newsletter you agree to these terms. If you do not agree, please do not use them.

What the information is, and is not

  • Information, not advice. Everything here is general information about public data, government and elections. It is not financial, investment, tax, legal or voting advice. Decide for yourself, and talk to a qualified professional about your own situation.
  • No endorsements. We do not support or oppose any candidate, party, ballot measure or bill. Arguments shown for or against are the stated views of the people and groups named.
  • Accuracy. Figures come from the official or named sources linked beside them and are checked, but sources revise numbers and mistakes happen. Before relying on a figure, confirm it with its source. For voting, always use your official voter guide and election office.
  • Corrections. If you find an error, email hello@theopencount.com. Confirmed errors are fixed and noted on the page.

Using our content

  • You may read, share and quote our pages, charts and newsletter for any non-commercial purpose, with credit to “The Open Count” and a link to the page.
  • Underlying public data belongs to its publishers, such as federal and state agencies; their terms apply to it.
  • Please do not copy the site wholesale, present our work as your own, or use automated tools in a way that overloads the site.

Paid subscriptions

  • The newsletter and any paid subscription are provided through Substack, which handles sign-up, billing and payment processing. Substack's terms of use also apply.
  • Subscriptions renew automatically at the price and interval shown when you subscribe, monthly or yearly, until you cancel.
  • You can cancel at any time from your Substack account settings. Cancellation stops future charges; you keep access until the end of the period already paid for.
  • Refunds are not normally given for partial periods. If you were charged in error or have a problem with a charge, email hello@theopencount.com and we will review it.
  • We may change subscription prices with advance notice by email; a new price applies from your next renewal after the notice.

Links and other services

We link to news articles, government sites, social media and other services we do not control. Their content and policies are their own.

Limits on our responsibility

The site and newsletter are provided “as is”, without warranties of any kind. To the fullest extent the law allows, we are not liable for any loss or damage that results from using or relying on them. Nothing in these terms limits any rights you have under law that cannot be waived.

Changes

We may update these terms. The date at the top shows the latest version; continuing to use the site or newsletter after a change means you accept the updated terms.
